Club Terms and Agreement

Terms and Conditions of Use of Personal Data

The personal data provided by the Member will be processed by Ducati Club of Jacksonville – a  dba non-profit organization for the purpose domiciled at the Florida Department of State Division of Corporations, using prevalently electronic and automated means for the following purposes:

 (i) to allow the Member registration and his/her authorized access to services as provided in the relevant General conditions of contract, to allow the performance of this contract between Ducati Club of Jacksonville and the Member and all the related activities and obligations.  Only for the above-mentioned purposes your personal data may be communicated by Ducati Club of Jacksonville to companies of the Ducati group, to Ducati subsidiary companies, to companies having a contractual relationship with Ducati and/or to companies part of the Ducati sales and assistance network (such as branches, importers, dealers, distributors, garages); data will be brought to data processors and persons in charge of the processing knowledge designated by Ducati Club of Jacksonville and by aforesaid subjects.

 (ii) to allow Ducati Club of Jacksonville and its sales and assistance network to fulfil market searches and customer satisfaction surveys. Only to these purposes your personal data may be communicated by Ducati Club of Jacksonville to companies of the Ducati group, to Ducati subsidiary companies, or to companies part of the Ducati sales and assistance network (such as branches, importers, dealers, distributors, garages). 

Regarding the aforementioned purposes, except as specially indicated above, data provided by the Member will not be assigned to third subjects by Ducati Club of Jacksonville and will not be disseminated.

Providing your data for the purposes of point (i) is voluntary, i.e. it’s not required by the law, but it’s necessary to complete the registration process, to conclude and to perform the related contract. In default of providing the data indicated as “required” in the registration form the consequence will be that you won't be allowed to complete the registration process and to conclude the related contract.
Providing your data for the purposes of point (ii) is voluntary, i.e. it’s not required by the law: in default of providing the data for these purposes the only consequence will be the impossibility to be contacted by Ducati Club of Jacksonville and its sales and assistance network to fulfil market searches and customer satisfaction surveys.
For updating purpose, data provided by the Member during the registration process may be checked with other data in Ducati Club of Jacksonville’s lawful possession as provided by the Member in other circumstances.

Club Code of Ethics                                                                                                          

Ducati Club of Jacksonville, “Club” brings together persons who have a passion for the Ducati brand and promotes such passion, sharing the values and vocation of the brand and the company, Ducati.  Our goal is to organize and take part in activities to build an active, dynamic community that shares the same passion.  Club members must agree to follow principles of honesty and respect of others as promoted by Ducati.

 

Club Regulations and Hold Harmless Waiver Agreement

Members must agree to follow principles of honesty and respect of others as promoted by Ducati.

Members must agree to perform activities in compliance with the law and applicable regulations in force and not to make improper use of the benefits granted by the Club.  The Club operates as fully independent, separate and autonomous from Ducati and its sponsors, “Sponsors” and under no circumstances shall the Sponsors be held liable for the Club’s activities.

Members must agree to operate and promote safe riding and road safety according to criteria and in compliance with applicable rules, and to promote Ducati’s initiatives in this regard.  Thus for the purpose of this initiative, the Club requires all members and their passengers to wear the recommended protective apparel and a helmet when participating in any Club sanctioned rides.

Members must agree that he/she the member, their spouse, heirs, agents, assigns, representatives, executors, or relative parties, to Waive, Release, Hold Harmless and Not to Sue the Club and its Sponsors from any claim, injury, loss, damage, cause of action or liability relating to Club sanctioned events and activities.  Members acknowledge that he/she is freely and expressly assuming and accepting any and all risks or personal or financial injury or death and property damage including those caused by the negligence or releases and/or and design, manufacturing or assembly defects in the equipment, facilities, and or activity while participating in Club events.

Members understand and agree to take full financial responsibility for any damage or injury to self, others or property that occur during Club and Sponsor sanctioned activities, regardless of the cause or reasons.

Members must agree that his/her membership can be terminated, rescinded or not renewed at anytime without cause as such deemed by the Officers of the Club.  Fees paid are not refundable

Members agree to any photographic or video capture of their likeness or images during Club activities for the purpose of use in public and commercial promotions, print and electronic campaigns by the Club and Sponsor
